Offical Contest Rules
1. NO PURCHASE, FEE, OR PAYMENT NECESSARY TO ENTER OR FOR YOUR COOKIE RECIPE TO BE SELECTED TO BE PRODUCED. PURCHASES, FEES, AND PAYMENTS WILL NOT INCREASE THE CHANCES OF HAVING YOUR COOKIE RECIPE SELECTED. THE CHANCES OF YOUR COOKIE RECIPE BEING SELECTED DEPEND ON THE ASSESSMENT OF THAT RECIPE BY A PANEL OF JUDGES ACCORDING TO THE CRITERIA SET FORTH BELOW. CONTEST OPEN TO RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE 18 YEARS OF AGE OR OLDER AT THE BEGINNING OF THE CONTEST. CONTEST BEGINS DECEMBER 21, 2009 AT 12:01 AM EASTERN TIME AND ENDS FEBRUARY 15, 2010 AT 11:59 PM EASTERN TIME (THE “CONTEST PERIOD”).
2. ELIGIBILITY: Contest open to individual persons who are legal residents of the 50 United States and the District of Columbia and who are 18 or older as of the beginning of the Contest. Current and former employees, contractors, directors, and officers of The Food Allergy & Anaphylaxis Network (FAAN) and Divvies LLC (Divvies), Great Wolf Resorts, Inc. (Great Wolf), their immediate family members (parent, child, sibling, and spouse), and those living in the same domicile therewith are ineligible.
3. TO ENTER: To be eligible for consideration and possible selection for production, your cookie recipe(s) must meet all of the following criteria: They must be in English; they must not contain peanuts, tree nuts, milk, or eggs; they must be your original work and creation; they must not contain or incorporate any material owned by any third party and cannot have been previously published or won another contest or competition; and you must not assign or license to any other party any copyrights or other rights in your recipes. To enter your eligible recipe(s) (“Recipe”), register at FAAN’s website at www.foodallergy.org, provide the requested registration information (including name, valid email address, date of birth, and mailing address), and submit your Recipe(s) using the online submission form, which will automatically enter the recipe(s) in the Contest. You may submit as many Recipes as you like, but you must submit each Recipe separately using a separate online submission form. Your Recipe(s) must be submitted during the Contest Period.
4. ASSESSMENT AND SELECTION OF RECIPES: Each eligible Recipe that you submit during the Contest Period will be assessed and rated by a panel of judges selected by FAAN and Divvies (which may include employees of FAAN and/or Divvies and/or representatives of Divvies alone, in their sole discretion, according to the following criteria: taste, presentation, overall breadth of appeal, and overall ability to be commercialized (the “Judging Criteria”). On or about March 1, 2010 the judges or Divvies will select, from all eligible entries, 5 Recipes which will be modified for possible commercialization and test production (“Finalists”). On or about April 1, 2010, and after modification and test production, the judges will select 1 Recipe which will be owned and may be commercially produced by Divvies (“Grand Prize Winner”) A portion of Divvies proceeds from the sale of cookies made with that modified Recipe will be donated to FAAN for its charitable mission. Your chances of having your Recipe(s) selected for modification, test production, and/or commercial production depend on the judges’ assessment(s) and rating(s) of your Recipe(s), according to the Judging Criteria.
5. NOTIFICATION: The Finalists will be notified by electronic mail on or about March 1, 2010. The Grand Prize Winner will be notified by electronic mail on or about April 1, 2010. The names of each Finalist will be posted on FAAN’s and Divvies websites.
6. PRIZES:
One (1) Grand Prize with a total approximate retail (“ARV”) value of $2,800. Specifically:
From Great Wolf Resorts:
Two (2) nights’ accommodations at a Great Wolf Lodge Resort (“Resort”) in the United States. The Grand Prize Winner may request a specific Resort location, but the location is subject to approval by the Sponsors in their sole discretion. Accommodations consist of a Family Suite and waterpark passes for each registered guest (not to exceed 6 guests) for the duration of stay. Total ARV of these accommodations is $800. Grand Prize Resort stays must be completed within one (1) year of notification of winning or prize will be forfeited. Any difference between stated ARV and final ARV will not be awarded. Lodging is subject to availability, certain restrictions, and blackout dates.
From FAAN: Transportation for the Grand Prize Winner and up to 3 guests to and from the selected Resort if the Grand Prize Winner resides more than one hundred fifty (150) miles from the selected Resort. Transportation includes round trip coach-class air transportation from a major commercial airport near Grand Prize Winner’s residence (as determined by FAAN in its sole discretion) to a major commercial airport near the Resort (as determined by FAAN in its sole discretion), subject to a limit of $500 per passenger. Since Grand Prize Resort stays must be completed within one (1) year of notification of winning or prize will be forfeited, the same limitations apply to the award of transportation. Total ARV for transportation will not exceed $2,000. All expenses not specifically mentioned herein are not included and are solely the Grand Prize Winner’s responsibility, including but not limited to: ground transportation, alcoholic beverages, fax, food, gratuities and tips, insurance, laundry service, merchandise, parking, room service, service charges, souvenirs, Resort activities, in-room charges and telephone calls. Resort regulations and conditions apply.Four (4) Finalist Prizes.
The four (4) Finalists who do not receive the Grand Prize will each receive a $100 Gift Certificate from Divvies (Total ARV $400)
7. TAXES: Any taxes, and all expenses other than those specifically enumerated above, are the sole responsibility of the Finalists. All federal, state, and local laws apply.
8. OWNERSHIP AND USE OF RECIPES: All entrants, by participating in this Contest and submitting Recipes, perpetually and irrevocably grant, assign, and transfer to Divvies (including any of Divvies’ successors and assigns) all right, title, and interest in the Recipes that they submit. Entrants’ opportunity to submit their Recipes and participate in this Contest constitutes full consideration for the foregoing grant. The foregoing grant requires no further consideration and is not dependent on entrants’ receiving any prizes, payments, compensation, or other consideration. Divvies can modify, use, or decline to use any submitted Recipes in Divvies’ sole discretion, and Divvies is not required to commercially produce or sell cookies made from the Recipe selected for commercial production in any particular quantity or for any particular period of time. All entrants specifically acknowledge that Divvies may use any Recipe that they submit for commercial purposes, among other things.
By entering the Contest you represent and warrant that (i) you own all rights in and to the Recipe, including all copyrights, trademarks and all other intellectual property rights, (ii) you agree that the Recipe becomes the sole property of Divvies, and (iii) you hereby perpetually and irrevocably assign, convey and transfer to Divvies (including any of Divvies’ successors and assigns) any and all rights, title and interest, and all residual interests, in the Recipe and any and all concepts embodied therein, including without limitation, all copyrights and any renewals and extensions thereof.
Divvies reserve the right in their sole discretion to use, produce, modify, edit, and/or otherwise change your Recipe without any compensation of any kind or attribution to you, and/or publish, post or broadcast your Recipe in any media whatsoever in the world, whether now known or developed in the future, without any compensation of any kind or attribution to you. The Recipe must not contain any material that is unlawful or in violation of any applicable federal, state or local law, rule or regulation. Divvies is not required to commercially produce or sell cookies made from the Recipe selected for commercial production in any particular quantity or for any particular period of time.
9. GENERAL CONDITIONS: All online submission forms become the sole property of FAAN and Divvies and will not be acknowledged or returned. All entries and submissions are subject to verification. FAAN and Divvies assume no responsibility for entries or submissions that are lost, late, misdirected, stolen, illegible, undelivered, garbled, damaged, mutilated, incomplete, reproduced mechanically, forged, falsified, altered, or tampered with (and any such entries or submissions are ineligible), or for any computer, online, telephone, or technical malfunctions that may occur. FAAN and Divvies assume no responsibility for any technical problems in connection with the transmission or receipt of entries, including faulty electronic data transmission, traffic congestion on the Internet or on websites, hardware or software error, equipment failure or malfunction, or other online communications problems. In the event of disputes regarding the identities of the persons submitting entries, entries will be deemed made by the individuals who identify themselves on the entry forms. FAAN and Divvies may publish the names of all entrants.
By accepting the Grand Prize, the Grand Prize winner authorizes FAAN and Divvies and their promotional partners to use his/her name, voice, likeness, city and state residence, and /or photograph in promotional material and for advertising and public relations purposes throughout the world, without further compensation of any kind, to the full extent permitted by law, although Sponsors are not obligated to use any of the above-described information or material. Except where prohibited by law, in order to receive the Grand Prize, the potential Grand Prize winner may be required to memorialize and execute a written assignment of rights in the Recipe, an Affidavit of Eligibility, and/or a Liability/Publicity Release within 14 days of receipt of notification. Failure to execute such document(s) may result in the forfeiture of the Grand Prize. If for any reason this Contest cannot be run or completed as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause which corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Contest, FAAN and Divvies reserve the right, at their sole discretion, to disqualify any individual who is responsible or who tampers with the Contest, and to modify, cancel, or terminate the Contest and select Recipes from all eligible entries received prior to the cancellation or termination. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY VIOLATE CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, FAAN AND DIVVIES RESERVE THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY PERSON RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. This Contest is subject to all applicable laws and regulations, but is governed by the substantive law of the Commonwealth of Virginia. Void wherever prohibited or restricted by law. Any claims related to this Contest must be resolved in the federal or state courts serving Fairfax, Virginia. Entrants agree to abide by the Official Rules and the decisions of FAAN and Divvies with respect to this contest, which are final.
